Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita/Section 482 Cr.P.C., to call for the records relating to the trial in C.C.No.181 of 2023 on the file of the Judicial Magistrate -I, Tambaram and quash the same.

O R D E R

When the matter was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the trial Court has already framed charges and that the case is now posted for examination of LW.1 to LW.4.

At this juncture, the learned counsel appearing for the petitioner sought permission of this Court to withdraw the Criminal Original Petition and has also made an endorsement to that effect. He further submitted that there is absolutely no material as against the petitioner and that she has been falsely implicated. Since the petitioner happens to be the wife of the 1st accused, he prayed that the presence of the petitioner may be dispensed with and also liberty may be granted to challenge the charges framed.

In view of the submission and endorsement made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn, with liberty to challenge the charges framed. 4.

The personal appearance of the petitioner before the trial Court is dispensed with except for receipt of copies, answering the charges, 2/4

questioning under section 313 Cr.P.C./Section 351 of BNSS, on the date of pronouncing judgment and also on any other dates as may be required by the trial Court. It is made clear that the petitioner shall be duly represented by her counsel on all hearing dates. Consequently, Crl.M.P.No.1353 of 2026 is ordered and Crl.M.P.No.1352 is closed.
