[Order of the Court was made by SUNDER MOHAN, J.] The petitioner seeks relaxation of the condition, to report before the Additional District Judge, Kancheepuram every Monday at 10.30 a.m until further orders, in Crl.M.P. No.10734 of 2023 in Crl.A. No.530 of 2022, dated 27.09.2023.
2. This Court, through orders dated 27.09.2023, in Crl.M.P. No.10734 of 2023 in Crl.A. No.530 of 2022, directed the petitioner/A5 as follows: "20. In view of the above reasoning, this Court is inclined to allow the petition, however, with the following conditions: ---- (iv) The petitioner/A5 shall remain/reside within the Revenue District of Kancheepuram, furnish the temporary address to the Additional District Judge, Kancheepuram and shall not leave the Revenue District of Kancheepuram without prior permission from the Additional District Judge,Kancheepuram.
(v) The petitioner shall report before the Additional District Judge, Kancheepuram every Monday at 10.30 a.m. until further orders".
3. The petitioner seeks relaxation of the abovesaid conditions in order to enable him to earn his livelihood, on the ground that he has been complying with the same ever since the date of order.
4. Learned Additional Public Prosecutor also conceded that the petitioner has been regularly complying with the abovesaid conditions imposed by this Court in Crl.M.P. No.10734/2023 and did not raise any serious objection in relaxing the same.
5. In view of the said submission made on either side, we deem it appropriate to modify the condition imposed by this Court in paragraph 20(v) in Crl.M.P.No.10734 of 2023 in Crl.A. No.530 of 2022 as follows:
"The petitioner shall report before the Additional District Judge, Kancheepuram, on the first working day of every month." The other condition imposed in para 20(iv) shall stand relaxed.
6. With the above modification, this Criminal Miscellaneous Petition stands ordered.
