ORDER

This writ petition has been filed for issuance of Writ of Mandamus, directing the first respondent herein to consider and pass orders on the appeal dated 22.07.2021 submitted by the petitioner under Patta Passbook Act requesting to cancel the patta bearing No.37 issued for the property of an extent of 190 sq.mt in survey No.297/2 (Old survey No.136/2 part) of Parivakkam Village, Poonamallee Taluk, Thiruvallur District. https://hcservices.ecourts.gov.in/hcservices/

2. Heard, Mr.V.R.Appaswamee, learned counsel appearing for the petitioner and Mr.A.M.Ayyadurai, learned Government Advocate appearing for the respondents 1 & 2.

3. The petitioner challenged the patta issued in favour of the third respondent in respect of the property comprised in survey No.297/2 (old survey No.136/2 part) to an extent of 190 sq.mt situated at Parivakkam Village, Poonamallee Taluk, Thiruvallur District, before the first respondent and the same is pending.

4. Considering the above, the first respondent is directed to issue notice to the petitioner and the third respondent and conduct enquiry, after giving them an opportunity of hearing, and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs.
