ORDER
This petition has been filed to direct the learned Judicial Magistrate No.II, Tindivanam to dispose of the case in C.C. No.117 of 2008 at the earliest.
2. The learned counsel for the petitioner has submitted that the petitioner is aged about 78 years and based on the complaint lodged by the petitioner, the respondent has registered a case in Cr.No.5 of 2008 on 28.04.2008 and charge sheet was also filed under Sections 465, 468, 469, 471 and 420 of IPC against 22 persons. He further submitted that some of the accused persons have filed Crl.OP.No.13340 of 2013 and 4062 of 2014 before this Court to quash the charge sheet against them and obtained interim stay and hence the trial court could not proceed further. He further submitted that by the order dated 25.11.2019, this Court dismissed the aforesaid Crl.OPs, and hence he requested to direct the Trial Court to expedite the Trial and dispose of the case in C.C.No.117 of 2008 at early. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Additional Public Prosecutor has submitted that out of 22 accused, 3 accused died and the remaining accused persons are appearing before the trial court. He further submitted that 17 witnesses were cited on the side of the prosecution. Hence, he requested to fix a reasonable time for disposal of the aforesaid case.
4. Considering the aforesaid submissions, the Trial Court is directed to dispose of the case in C.C.117 of 2008 within six months from the date of receipt of copy of this order.
5. With the aforesaid directions, this petition is disposed of.
