Respondent/Respondent Prayer.: This Civil Miscellaneous Appeal has been filed under Section 173 of the Motor Vehicles Act, 1988 against the Judgment and Decree dated 17.06.2008 made in M.C.O.P.No.337 of 2006 on the file of the Motor Accident Claims Tribunal (Principal Subordinate Judge) Krishnagiri.

J U D G M E N T
This civil miscellaneous appeal was argued on several occasions and the learned counsel for the appellant has requested time and the case was adjourned. However, after completing the arguments, the leaned counsel for the appellant has not appeared before this Court. The learned counsel for the respondent - Transport Corporation was directed to file a copy of the counter before the Tribunal as there was some doubt as to why the counter would be filed partially in Tamil and English. The records also called for and verified the same.
2. The respondent - Transport Corporation extracted the statement of the driver of the bus involved in the case wherein categorically stated that the bus was not involved in the accident.

3. In the light of the above, I am inclined to dismiss the appeal. No costs.
