The Second Appeal is filed under Section 100 of CPC against the judgment and decree dated 25.11.2002 in A.S.No.78 of 1999 on the file of the Subordinate Judge Court, Udumalpet, confirming the judgment and decree dated 23.07.1999 in O.S.No.431 of 1994 on the file of the District Munsif Court, Udumalpet. For Appellant : No Appearance For Respondent : Notice served - No Appearance ORDER:

This second appeal is directed as against the judgment and decree dated 25.11.2002 in A.S.No.78 of 1999 on the file of the Subordinate Judge Court, Udumalpet, confirming the judgment and decree dated 23.07.1999 in O.S.No.431 of 1994 on the file of the District Munsif Court, Udumalpet.

2. On 10.12.2019, no one appeared on behalf of the appellant. Therefore, the matter was ordered to be posted on 11.12.2019 under the caption "for dismissal". Further, though notice was sent to the respondent, the respondent refused to receive notice. Therefore on 11.12.2019, it was ordered to be printed the name of the respondent in the cause list. Even then, the appellant has not appeared before this court today, which shows that the appellant is not interested to proceed with this second appeal further.

3.Therefore, the Second Appeal is dismissed for non-prosecution. Consequently, connected miscellaneous petition is closed. No costs.
