[Order of the Court was made by R.SUBRAMANIAN, J.] The petitioner seeks condonation of delay of 326 days in filing the petition to restore W.A.No.709 of 2010, which was dismissed for default.
2. Notices were ordered to the respondents. The respondents 1 to 3 have been served and they are appearing through counsel. The respondents 4 and 5 are yet to be served. We find from the records that the respondents 4 and 5 were not served with notice in the Writ Appeal, before it was dismissed for non-prosecution. Hence, notice to them in this petition is deemed unnecessary.
