ORDER
The petitioner, who was arrested and remanded to judicial custody on 09.12.2025, for the offences punishable under Sections 7, 20(1), 20(2) of Cigarette and other Tobacco Products Acts, 2003 and Sections 275 & 123 of the BNS, 2023 in Crime No. 106 of 2025 on the file of respondent police 1/4
seeks bail.
2. The allegation against the petitioner is that the petitioner herein was found in transportation of banned tobacco products by using a two wheeler, the respondent police intercepted the accused and, based on his statement, the respondent police recovered a quantity of 331 kgs of banned tobacco products from the petitioner herein, and the petitioner has been arrested on 09.12.2025.

The learned counsel for the petitioner submitted that petitioner has not committed any offences as alleged by the prosecution and he has been falsely implicated in this case and he was arrested and remanded to judicial custody from 09.12.2025 and now, he is ready to abide by any condition imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the properties worth about Rs.2,41,500/- have been recovered from the petitioner herein and he is not having any previous case, and therefore, he opposed for grant of bail to the petitioner.

5.Considering the huge quantity of 331 kgs of banned tobacco products worth about Rs.2,41,500/- recovered from the petitioner herein; that investigation is pending, and if bail is granted to the petitioner he would indulge similar offences in future hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition shall stands dismissed.
