This appeal preferred by the plaintiff, who lost her case seeking partition against the respondents, before the Courts below. When the case was listed for final disposal, the learned counsel appearing for the appellant sought time to communicate the matter to the parties and get instruction. Accordingly, letter sent to the appellant is returned "unserved". Therefore, the learned counsel appearing for the appellant has filed a memo reporting the return of postal cover. Hence, this Second Appeal is dismissed for non prosecution. No costs. Consequently, connected Miscellaneous Petition is closed.
