Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Vacate the Stay granted by this Hon'ble Court in WMP No.7227 of 2016 in WP No.8111 of 2016 on 04.03.2016 pending WP No.8111 of 2016.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.V.SHANMUGANATHAN, Advocate for the petitioner and of MR.M.R.RAGHAVAN Advocate for the 2nd respondent the court made the following order:- This writ miscellaneous petition has been filed to vacate the stay granted by this Court on 04.03.2016. Considering the facts and circumstances and submissions at the instance of the 2nd respondent/workman, this Court is not inclined to allow the prayer made by the petitioner in this Writ miscellaneous petition. It is brought to the knowledge of this Court that a sum of Rs.2,00,000/- having been deposited before the 1st respondent / Presiding Officer, Labour Court. 2.

In view of the above circumstances, this Court directs the 1st respondent / presiding officer to release an amount of Rs.1,00,000/- in favour of the respondent / workman, who is the petitioner in ID No.181 of 2007 with a period of two weeks from the date of receipt of copy of this order, through RTGS and the

remaining amount of Rs.1,00,000/- shall be kept in a Interest bearing Fixed Deposit Account in any of the Nationalised Bank by the 1st respondent/ Presiding Officer, Labour Court, Salem. However, petitioner is at liberty to make a mention before the appropriate learned Hon'ble Judge who assigned with the roaster, for early disposal of the main writ petition.
