This Civil Miscellaneous Petition is filed to condone the delay of 74 days in filing the Appeal.

Though learned counsel for the respondent had filed a counter and vehemently opposed for condoning the delay, having heard the learned counsel for the petitioner and on being satisfied with the reasons stated in the affidavit filed in support of the petition, we allow this Civil Miscellaneous Petition and condone the delay.

3. Registry is directed to number the Appeal and list the same for Admission, if it is otherwise in order.
