The Dean, Government Yoga and Naturopathy Medical College and Hospital, : Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of certiorarified mandamus to call for the records relevant to the selection process which was conducted by the 2nd respondent for the admission of B.N.Y.S Medical Degree Course, dated 07-01-2021, quash the same as illegal, improper, unreasonable, arbitrary against the principles of natural justice and thereby direct the 2nd respondent to recalculate the petitioner's sports point as per application prospectus in APPENDIX IV and to give admission to the petitioner for the course of B.Y.N.S Medical Degree Course 2020-2021.

ORDER

The grievance of the petitioner is that though she has obtained so many Medals and certificates in the Sports, the respondents have selected two other persons in the Sports quota.

The learned Special Government Pleader Mr.Kathirvel appearing for the respondents has submitted that the course for which the petitioner had applied itself is for Naturopathy and Yoga and the respondents have given preference to two students viz., S.Geethiga and R.S.Vysaaly, who possess certificate in Yoga.

3. A perusal of the typed set of papers furnished by the petitioner gives a clear picture that the petitioner had participated in the field of Wait Lifting as evident from page 195 of the typed set of papers whereas page Nos.197 and 199 reveal that the other two candidates referred to above had participated in Yoga and therefore, preference was given to them. Since respondent is conducting the course for Naturopathy and Yoga Sciences, the preference provided to those candidates cannot be found fault with. Accordingly, this writ petition is dismissed. No costs. The connected Miscellaneous Petition is also dismissed.
