Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondents 1 to 7 to consider the Petitioner's representation dated 10.04.2012 and thereby direct the respondents 1 to 7 to take suitable action against the 8th respondent and enable the petitioner's wife to receive the cheque amount. The relief sought for in this writ petition is to direct the respondents 1 to 7 to consider the Petitioner's representation dated 10.04.2012 and to take suitable action against the 8th respondent to enable the petitioner's wife to receive the cheque amount.

According to the petitioner, he is a retired Village Administrative Officer and his wife A. Manoramadevi was working as a Saleswomen in the Fair Price Shop which belongs to the 8th respondent. While so, his wife taken life insurance policy bearing No.731727803, which got matured on 27.03.2012 and hence, the Life Insurance Corporation of India issued a cheque in respect of matured policy through registered post, but the petitioner's wife has not received it. When enquired about the non receipt of cheque amount, it was informed that the 8th respondent had received the registered envolope, which was sent in the name of petitioner's wife. Therefore, the Petitioner made a representation dated 10.04.2012 to the respondents 1 to 7, which was not considered. Finding no other option, she has come up with this writ petition for the aforesaid relief. 3.

Today, when the matter is taken up for hearing, the learned counsel for the petitioner submitted that the petitioner's representation dated 10.04.2012 is pending and it may be directed to be considered by the respondents 1 to 7, on merits, within a reasonable time to be fixed by this Court, for which, the learned Government Advocate appearing for the respondents 1 to 7 has no serious objection.

Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on

either side, this Court directs the third respondent to consider the representation of the petitioner dated 10.04.2012, if not already considered, and pass appropriate orders, on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner and the eighth respondent. Such an exercise shall be completed within a period six weeks from the date of receipt of a copy of this order. 5.

This Writ Petition is disposed of with the above direction. No costs.
