ORDER

This Writ Miscellaneous Petition has been filed to modify the order of this Court dated 10.06.2025 by deleting the last sentence i.e "Hence the impugned order passed by the 2nd respondent is hereby set aside." in Para No.4 in W.P.No.11623 of 2024.

2. It is submitted by the learned counsel for petitioner that the aforesaid writ petition was disposed of vide order dated 10.06.2025. It is further submitted that an inadvertent error has crept into the said order in Paragraph 4, wherein, it has been stated that the impugned order passed by the 2nd respondent is hereby set aside. Learned counsel would submit that the second respondent had not passed any such impugned order, and therefore, the said observation requires correction for the sake of clarity. Hence, the learned counsel for petitioner seeks modification in Paragraph 4 of the said order. To which the learned counsel for respondents did not seriously object.

3. Heard both sides.

4. In view of the said submission made by the learned counsel for petitioner, Paragraph 4 of the order dated 10.06.2025 shall stand substituted as follows:

" 4. In such view of the matter, the Settlement Cancellation Deed dated 26.09.2005 and the consequential Sale Deed dated 28.10.2005 is void and non est."

5. Except the above modification, all other paragraphs made in the earlier order dated 10.06.2025 shall remain intact. Accordingly, the Writ Miscellaneous Petition stands ordered.
