2016-08-24Honourable Mr Justice R.Subbiah3 pages

W.M.P.No.11019 of 2016 in W.P.No.13230 of 2013 R.SUBBIAH, J The present petition has been filed to incorporate the word ' first respondent ' in the place of ' third respondent ' in the order dated 26.2.2016 made in W.P.No.13230 of 2013.

2. Originally, the petitioner association filed the writ petition in W.P.No.13230 of 2013 seeking a direction to the third respondent to dispose the representation dated 25.11.2012 made by them relating to disbursement of grants. This Court, by an order dated 26.2.2016, directed the petitioner association to submit a copy of the representation dated 25.11.2012, along with a copy of the said order to the third respondent and on receipt of such representation, the third respondent was directed to pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of that order. Now, the petitioner has come up with the present petition for the relief stated supra.

3. Learned counsel appearing for the petitioner submitted that the appropriate authority is the first respondent, not the third respondent, but, however, inadvertently, it has been mentioned as third respondent in the prayer column of the writ petition.

4. In view of the said submission made by the learned counsel appearing for the petitioner, the petition is allowed and the learned counsel appearing for the petitioner is directed to amend the prayer of the writ petition and on carrying out the amendment, the registry is directed to incorporate the word ' first respondent ' in the place of ' third respondent ' in para 6 of the order dated 26.2.2016 made in W.P.No.13230 of 2012 and issue fresh order copy to the parties concerned. However, the petitioner is directed to pay the costs for the certified copy of the said order. 24.08.2016 sbi
