PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the Respondents to grant higher pay scale of Rs.5,200-20,200/- together with grade pay of Rs.1,900/- per month to the petitioners from the date they discharged the duties in the post of sanitary/conservancy supervisor with all attendant benefits including arrears and pass orders.

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

2. The petitioner has filed this writ petition seeking a direction to the Respondents to grant higher pay scale of Rs.5,200-20,200/- together with grade pay of Rs.1,900/- per month to the petitioners from the date they discharged the duties in the post of sanitary/conservancy supervisor with all attendant benefits including arrears and pass orders.

3. The facts of the case is that the petitioners got appointed as Sanitary workers in the Respondent/Corporation and thereafter promoted as Record Clerk. Pursuant to which the services were converted as Sanitary/Conservancy Supervisor. The sum and substance of the case is that inspite the fact that the petitioners were rendering the service as Sanitary/Conservancy Supervisor the pay scale has not been revised and they are receiving only the older pay. Hence a representation was made to the respondent on 23.10.2024 in this regard. However, there was no progress in the said representation, which has given rise to this petition. 3.The learned counsel for the petitioner submitted that it would be 2/4

suffice if this Court issues a direction to the respondent to consider the petitioner's representation and pass orders. 4.The learned Standing counsel appearing for the Respondent submitted that they will consider the case of the petitioner and take action in the manner known to law.

Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioners representation and fix the eligible pay scale to which they are entitled and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the aforesaid direction, this Writ Petition stands disposed of. No costs.
