Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Certiorari, to call for the records and quash the impugned proceeding of the 2nd respondent in Na.Ka.K3/25678/2021 dated 30.12.2025.

O R D E R

This writ petition is filed for the following relief: "To call for the records and quash the impugned proceeding of the 2nd respondent in Na.Ka.K3/25678/2021 dated 30.12.2025. ."

2. The only challenge to the show cause notice is that the same has been issued by the 2nd respondent contrary to the directions of this Court in WP.No.36546 of 2023 dated 01.12.2025, wherein in paragraph No.6 this Court has held as follows:

"6. It is for the 1st respondent to take decision by taking into consideration that the petitioner has been running the Fair Price Shop for many years. In the event the 1st respondent is of the view that the Fair Price Shop should be handed over to some other Women Self Help Group, instead of any Self Help Group, the 1st respondent may consider allotting the same Cooperative Society, so that there may not be any issue in future. No costs. Consequently, connected miscellaneous petitions are closed."

3. The impugned show cause notice has now been issued by the 2nd respondent and not the 1st respondent.

4. Therefore, the impugned order is quashed. This writ petition is allowed and the 1st respondent is directed to issue show cause notice and hold enquiry and after hearing the petitioner he shall pass orders as directed by the earlier orders of this Court in WP.No.36546 of 2023 3/6

dated 01.12.2025. Consequently, the connected miscellaneous petition is closed. No costs.
