Today, when the matter is taken up for hearing, learned counsel on either side present before this Court and submitted that the sole appellant and the sole respondent died. 2.Learned counsel for the appellant further submitted that she is not able to get instructions to bring the legal heirs on record to pursue the matter further.

3.In view of the above submissions made by the learned counsel for the appellant, this Second Appeal is dismissed as abated. However, there shall be no order as to costs.
