Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the second respondent to number the O.A petition filed under Section 64(1) of Tamil Nadu Hindu Religious and Charitable Endowments Act pending on the file of Joint Commissioner of H.R.&C.E., Coimbatore.

ORDER

Mr.V.Ponnusamy, claiming to be the de-facto trustee of Arulmighu Sridevi, Boodevi Sametha Sri Karunakara Venkatramana Perumal Temple situated at S.F.No.90, Karuvalur Village, Avinashi Taluk, Tiruppur District, has submitted an unnumbered O.A petition on 5.3.2018 under Section 64(1) of the Tamil Nadu Hindu Religious and Charitable Endowments Act before the second respondent to frame a scheme for the said temple. Although a month's time has lapsed, the office of the Joint Commissioner, H.R. & C.E. Department, Coimbatore has neither numbered nor https://hcservices.ecourts.gov.in/hcservices/

returned the petition and they are simply keeping it pending for more than 30 days. Therefore, the petitioner has come to this Court seeking a direction to number the O.A and then to proceed further to pass appropriate orders in the manner known to law.

2. The learned Special Government Pleader, taking notice for the respondents, fairly submitted that they have received the petition filed by the petitioner under Section 64(1) of the Tamil Nadu Hindu Religious and Charitable Endowments Act seeking directions for framing a scheme for the said temple and within two weeks time, the petitioner's O.A will be numbered and then will be processed further in the manner known to law.

3. Recording the statement made by the learned Special Government Pleader for the respondents, this writ petition stands disposed of accordingly. No costs.
