Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing Respondents to immediately conduct a joint survey, Identify all encroachments on the Pothathurpettai water Channel in Survey No.81, initiate eviction Proceedings under the Tamil Nadu Land Encroachment Act, 1905, restore the channel to its original width of 60 feet and complete the entire process within a strict time frame to be fixed by this Hon'ble court.

ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Prayer in this public interest litigation is to take a joint survey, identify all encroachments on Pothathurpettai water channel in Survey No.81, initiate eviction Proceedings under the Tamil Nadu Land Encroachment Act, 1905, restore the channel to its original width of 60 feet and to complete the entire process within a strict time frame.
2. We find that memo was sent by Tahsildar, Pallipattu to the Executive Officer of Pothathurpettai Town Panchayat for making
necessary arrangements to facilitate proper land survey.
3. Learned counsel for State, upon instruction, would submit that now the land survey has been fixed on 20.02.2026.
4. From the statement so made, we are of the view that, at this stage, it is not necessary for this Court to keep this matter pending. Depending upon the result of survey, appropriate action, as may be required under law, shall be undertaken by the competent authority.
