C.M.P.No.1364 of 2023 in C.M.A.SR.No.7634 of 2023 N.MALA.J., This Petition has been filed to condone the delay of 1066 days in filing the above C.M.A.SR.No.7634 of 2023.
2.Though notice was served to the respondent numbers 1 to 3, none appears before this Court. 3.Mr.S.Senthil Kumar, learned counsel appears for 4th respondent.
4.I have gone through the affidavit filed in support of the petition and I am of the view that the delay of 1066 days can be condoned on condition that petitioners shall forefeits interest for the delay period of 1066 days. The delay of 1066 days is therefore condoned on condition that the petitioners shall not be entitled for any interest for the delay period of 1066 days.
5.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission.
Registry is further directed to print the name of the respondents counsel at the time of admission. Accordingly, this CMP is ordered.
