WMP.No.8292/2017 in WP.No.31644/2015 M.SATHYANARAYANAN, J., The above petition has been filed by the petitioner seeking substitution of the 1st respondent as the Secretary to Government, Tourism, Culture and Hindu Religious and Charitable Endowment Department, Secretariat, Chennai-9 in stead of the Secretary to Government, Revenue Department, Fort St George, Chennai - 9. It is represented that in terms of the order dated 07.10.2015 which was further clarified by way of "Being Mentioned" vide order dated 24.11.2015, the Secretary to Government, Revenue Department, Fort St George, Chennai-9, was directed to consider and dispose of the proposal / recommendation of the 2nd respondent and however, the said exercise is to be done by the Secretary to Government, Tourism, Culture and Hindu Religious and Charitable Endowment Department, Secretariat, Chennai-9 and prays for amendment of the cause title.
Heard Mr.K.Dhananjayan, learned Special Government Pleader appearing for the respondents who has no serious objection in allowing of this petition.
Accordingly, the petition is ordered and the 1st respondent, viz., the Secretary to Government, Revenue Department, Fort St George, Chennai - 9 is to be substituted by the Secretary to Government, Tourism, Culture and Hindu Religious and Charitable Endowment Department, Secretariat, Chennai-9.
M.SATHYANARAYANAN, J., AP Paragraph No.5 of the order dated 07.10.2015 made in WP.No.3144/2015 is to be read as follows:- "This Court, taking into consideration of the above facts and circumstances, directs the 1st respondent to take into consideration the proposal / recommendation of the 2nd respondent in his Letter No.L2/12917/2006 dated 21.05.2013 and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order."
The Registry is directed to replace the above paragraph as paragraph No.5 in the order dated 07.10.2015 in WP.No.31644/2015 and issue fresh order copy to the respective parties on payment of necessary charges.
It is made clear that the newly substituted 1st respondent shall pass orders within a period of eight weeks from the date of receipt of a copy of this order.
