JUDGMENT

Both the learned counsel for the appellant and the learned counsel appearing for respondents 2 to 6 are present. Mediation report received. The matter was compromised between the parties due to the successful mediation effort made by the Tamil Nadu Mediation and Conciliation Centre whereby the appellant, who is https://hcservices.ecourts.gov.in/hcservices/

the defendant in the suit, is entitled to remain in the suit schedule properties while the respondents/plaintiffs have undertaken that they will not disturb the possession of the appellant/defendant in the suit schedule properties. Consequently, the Compromise Deed executed by both the parties is hereby recorded and the same shall form part of the record.

2. Accordingly, the Second Appeal filed by the defendant is allowed and the suit in O.S.No.559 of 1993 is dismissed. There shall be no order as to costs. The connected miscellaneous petition is closed.
