Appeal filed under Section 173 of the Motor Vehicles Act against the Decree and Judgment passed by the Motor Accident Claims Tribunal, (I Additional District Judge), Cuddalore in M.C.O.P.No.193 of 2004 dated 27.04.2015.
For Appellant : Mr.C.S.K.Sathish
JUDGMENT
This appeal is preferred by the vehicle owner against the award passed by the Motor Accident Claims Tribunal, Cuddalore awarding a sum of Rs.2,86,800/- for the injured motor accident victim.
2. While, this appeal filed and pending for disposal, the injured victim has filed an appeal for enhancement of compensation and the same was numbered as C.M.A.No.2102 of 2015 and disposed of by this Court on 27.04.2019, enhancing the compensation to Rs.3,94,720/-.
3. Since the High Court in the appeal has considered the award, which is impugned in the present civil miscellaneous appeal and passed the enhanced compensation, the learned counsel for the appellant would fairly submit that nothing survives in https://hcservices.ecourts.gov.in/hcservices/
this appeal.
4. Recording the same, this Civil Miscellaneous Appeal is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is also closed.
