2. It is represented by the appellant's counsel that the second appeal may be dismissed as withdrawn as the parties had settled the matter out of court and undertakes to file a memo to that effect.

3. In the light of the abovesaid position, the second appeal is dismissed as withdrawn. No costs. Consequently, connected civil miscellaneous petition,if any, is closed. The counsel for the appellant is directed to file a memo pointing to the abovesaid facts in the Registry immediately.
