Learned counsel for the petitioner submitted that though there was a delay in filing the appeal with the certified copy of the judgment of the Courts below, in view of the fact that the printed copies which were made ready thereafter and filed before this Court indicate that there is no delay, if the limitation period is considered from the dates available in the printed copy of judgment, the present application seeking for condonation of delay filed earlier has now become unnecessary. Therefore, he seeks permission to withdraw this application with liberty to move the Registry to number the appeal with the printed copies. Accordingly, this application is dismissed as withdrawn with liberty to the petitioner as stated supra.

Registry is directed to verify as to whether the appeal is in time, if the dates in the printed copies are taken into consideration.
