The learned counsel for the petitioner would submit that in this case, the respondents had acquired the subject lands of the petitioner to an extent of 1450 sq.mts., and paid compensation only for the extent of 1265 sq.mts. Further, the interest for the period from the date of acquisition till the date of deposit was not paid to the petitioner. In this regard, a representation dated 21.12.2023 was filed, however, the same was not at all considered by the respondents till date. Hence, this petition.

3. In reply, the learned counsel for the respondents would submit that the

petitioner's representation was filed only for the payment of compensation for remaining 185 sq.mts, however, no request was made for interest for the period between acquisition of land and deposit of compensation. Hence, he requests this Court to pass appropriate orders.

4. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.

5. In the case on hand, the respondents had acquired the subject land to an extent of 1450 sq.mts, however, paid compensation for only an extent of 1265 sq.mts. Hence, a representation was made by the petitioner, requesting the respondent to remit the compensation for remaining 185 sq.ft., of acquired land. However, as rightly contended by the respondent, the petitioner's representation was filed only for the payment of compensation, however, no request was made with regard to the entitlement of interest for the period from the date of acquisition of land till the date of deposit of compensation amount.

In view of the above, this Court directs the petitioner to file a fresh representation before the respondents, explaining on the aspect of his entitlement for interest on the compensation amount for the period between the acquisition of land and deposit of compensation. In such case, the respondents shall consider and dispose of the same, on merits and in accordance with law,

within a period of 12 weeks from the date of receipt of the representation.
