Mr.G.Saravanan, learned counsel takes notice for respondent No.4.

2. The petitioner / appellant filed an affidavit in support of the petition wherein it is stated that after filing the Second Appeal in S.A.No.965 of 2012 the 1st Respondent Mr.R.Narayananswamy passed away on 25.04.2014 and the 2nd respondent, who is the brother of the 1st respondent has been recognised as the legal representative of the 1st respondent on 25.04.2014. Now, the 2nd respondent Mr.R.Gurumoorthy also passed away on 17.11.2021 and his wife G.Savithiri predeceased him on 31.03.2020. During her life time, she executed a Settlement Deed on 14.08.2019 in favour of the 4th respondent Mr.S.Athmanathan. Further, the affidavit states that the 4th respondent now represents the estate of the 2nd respondent Mr.R.Gurumoorthy. 3.Accepting the reasons stated in the affidavit, this Court is inclined to allow the petition. Accordingly this civil miscellaneous

petition is allowed.

4. Registry is directed to carryout necessary amendments in the main Second Appeal.

5. Post the matter on 27.09.2024.
