Respondents Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the fourth respondent to conduct enquiry upon the charge memo vide Na.Ka.2987/2013/Sa.Pa dated 23.10.2015 issued by the fourth respondent.

This writ petition has been filed by R.Bhaskaran, seeking a writ of mandamus directing the fourth respondent to conduct enquiry upon the charge memo dated 23.10.2015.

2. Heard Mr.R.Karthikeyan, learned counsel for the petitioner and Mr.D.Venkatachalam, learned Government Advocate, who took notice for the respondents and with their consent, the writ petition is taken up for disposal at the time of admission.

3. The petitioner, who is working as Senior Inspector in Urban Co-operative Bank, was served with a charge memo dated 23.10.2015 stating that he is responsible for the missing jewels, for which, he submitted a detailed representation.

4. The grievance of the petitioner is that even though the petitioner has submitted a detailed representation dated 06.12.2013 with regard to the loss of jewels, without considering the same, the charge memo has been issued against him.

5. The learned counsel for the petitioner submitted that though the petitioner is prepared to face Departmental enquiry, after the issuance of charge memo, the respondents have not taken any steps to conclude the enquiry. Therefore, he sought for a direction to the Disciplinary Authority/fourth respondent herein, namely, the Deputy Registrar of the Co-operative Societies, Mannarkudi, to complete the Disciplinary Proceedings at the earliest.

In view of the above, this Court, without going into the merits of the writ petition, considering the limited prayer sought for by the petitioner, directs the fourth respondent to complete the pending Disciplinary Proceedings and pass orders on merits and in accordance with law, as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order.

The writ petition is disposed of with the above directions. No costs.
