Petition seeking bail in respect of Crime No.713 of 2024 registered for the offences punishable under Sections 22(c), 20(b)(ii)(B), 29(1) and 25 of NDPS 1/4
Act, 1985 is on board for consideration.
2.The incarceration of the petitioner being from 17.07.2024 pleading innocence on the part of the petitioner and false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He also submits that the petitioner is no way connected with the alleged offences and he is ready to abide by any stringent condition that may be imposed by this court. 3.The case of the prosecution, as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner and the other accused were found to be in possession of 70 grams of Methamphetamine and 1.200 kgs of ganja. He further submits that there are thirty five previous cases against the petitioner, in which four are under NDPS act.
4.Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record, this Court is of the opinion that the petitioner has 2/4
not satisfied the twin conditions as contemplated under Section 37 of NDPS Act and hence, this court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 24.01.2025 sai 3/4
