ORDER
The petitioners were arrested and remanded to judicial custody on 09.09.2025 for the offences punishable under Sections 302, 201, 379, 404 of IPC and subsequently altered into Sections 302, 201, 379, 404 of IPC in Crime No.670 of 2025, registered on the file of the respondent police, seeks bail. 1/6
2. The allegation against the petitioners is that they were involved in a case of murder and subsequently, they were granted bail. Subsequently failed to appear before the committal trial Court and hence Non-Bailable Warrant (NBW) was issued against them on 22.05.2023.
3. The learned counsel appearing for the petitioners submitted that the petitioners are ladies and are daily wagers working in different places. He further submitted that they had been regularly appearing before the concerned Court till 2023, and had appeared for more than ten years before the committal Court. However, a Non-Bailable Warrant came to be issued on 22.05.2023, pursuant to which they were arrested. He also submitted that the petitioners are ready to cooperate with the trial proceedings. Hence, he prays to grant bail to the petitioners.
4.Learned Government Advocate (Crl.Side) appearing for the respondent submitted that the case is now posted on 18.02.2026 for committal proceedings. He further submitted that there are totally four accused in this case and the petitioner herein is ranked as A4 and that the petitioner ha no previous case pending against him.. Hence, he opposed for grant of bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Considering the fact that the petitioner was already granted bail, and thereafter, due to non appearance before the Trial Court, NBW was issued and 2/6
the same has been executed and that Sessions case has now been committed, and the fact that the petitioners are being ladies, and also considering the period of their incarceration, this Court is inclined to grant bail to the petitioner subject to the following conditions:

Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties each, for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Villupuram and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioners shall report before the concerned Court daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation. [c] the petitioners shall not abscond either during investigation or trial;
[d] the petitioners shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action 3/6
against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
