The case of the petitioner is that she is the absolute owner of the property bearing Plot No. 138 (western side portion), measuring an extent of 2134 sq.ft., comprised in S.No.1166/1, as per TSLR New T.S.No.42/2, Patta No.3368, S.No.42/2, Block No.89, Ward-D, Thanigachalam Nagar, Chennai. The said property was purchased by the petitioner under a registered Sale Deed dated 29.10.2020, bearing Document No.5139/2020 on the file of SRO, Sembium. Ever since the date of purchase, the petitioner has been in absolute possession and enjoyment of the property.

It is the further case of the petitioner that subsequent to the purchase, the petitioner had availed a housing loan from TATA Capital Housing Finance Ltd., by executing a Memorandum of Deposit of Title Deeds vide Document No.5140/2020 registered on the file of SRO, Madhavaram. The said loan was later discharged vide Document No.6869/2023. Thereafter, the petitioner had executed another Deposit of Title Deeds in favour of Kotak Mahindra Bank Ltd., vide Document

No.6872/2023, which is still subsisting. The petitioner is regularly paying the monthly EMIs.

4. While so, the 2nd respondent, without any manner of right or authority, created a fraudulent Sale Deed dated 07.05.2024 bearing Document No.1214/2024 registered on the file of SRO. Madhavaram, in respect of the very same property. On verification of the Encumbrance Certificate, the petitioner came to know that the 2nd respondent had also relied upon certain bogus documents, including Document No.1210/2024.

5. According to the petitioner, the said sale deed relied upon by the 2nd respondent is fraudulent and created with an intention to grab the petitioner's property. In this regard, the petitioner has already lodged a complaint and an F.I.R. in Crime No.326/2025 has been registered on the file of Madhavaram Police Station for offences under Sections 324, 329(4), 351(3) of the BNS Act and the accused has been arrested and is in judicial custody. Taking advantage of the fraudulent documents, the 2nd respondent had obtained Electricity Service Connection No.01-075-0274580 in respect of the petitioner's property. The same was granted by the 1st respondent without proper verification of title documents. Immediately

on coming to know of the same, the petitioner had submitted a detailed representation dated 10.11.2025 to the 1 respondent requesting him to conduct an enquiry and cancel the electricity service connection granted in favour of the 2nd respondent. Though the said representation was duly served, no action has been taken so far. Hence the petitioner is before this Court.

6. The 3rd respondent has filed a status report today stating that the 2nd respondent has indulged in land grabbing. The same is taken on file.

7. Heard both sides and perused the materials available on record.

Considering the facts and circumstances of the case, without going into the merits of the case, this Court directs the 1st respondent to hold an enquiry on the petitioner's representation dated 10.11.2025 after issuing notice to the petitioner as well as the 2nd respondent and affording them a personal hearing, and pass appropriate orders on merits and in accordance

with law, within a period of four weeks from the date of receipt of a copy of this order. In case, the petitioner is able to prove her ownership of the subject property, the electricity connection issued in the name of the 2nd respondent shall be disconnected.
