For Petitioner : M/S.S.N.A.HUSSAINY Advocate For Respondent : MR. R.SEKAR, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A2, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 174(3) Cr.P.C., altered in to 306 IPC, in Crime No.97 of 2017 on the file of the respondent police and seeks anticipatory bail.

2.The case of the prosecution is that the deceased Shylaja married one Sridhar who is the sun of the petitioner herein on 26.02.2012 and from the date of marriage, both had difference of opinion and on 11.02.2017, the deceased Shylaja poured kerosene on her and set fire and died on 12.02.2017. This petitioner is the mother-in-law of the deceased.

3.The learned Government Advocate (crl.side) would submit that the petitioner is an aged person and the investigation is still pending.

4. The learned counsel for the petitioner submits that in this case, A-1 and other co-accused had been arrested and released on bail. He further submits that the petitioner is no way connected with the case. Hence, prays for anticipatory bail.

5. Considering the facts and circumstances of the case and taking note of the couple of fact that co-accused have been granted bail by this Court and she is an aged person, custodial interrogation of the petitioner is not necessary and therefore, this

Court is inclined to grant the relief of anticipatory bail to the petitioner.

6. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Magistrate concerned within a period of 10 days from the date of receipt of a copy of this order, on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Ponneri, or to the satisfaction of the respondent police or the Police Officer, who intends to arrest and on further condition the petitioner shall appear before the respondent police as and when required for interrogation.
