O R D E R

This Civil Revision Petition has been filed to strike off the plaint in O.S.No.95 of 2023, pending on the file of the District Munsif Court, Thiruvottiyur.

A perusal of the records that have been filed along with Civil Revision Petition would indicate that in the month of February 2024, the petitioner had filed an application to reject the plaint in the suit in O.S.No.95 of 2023, by invoking the provisions of Order VII Rule 11 of the Code of Civil Procedure. Subsequently, the petitioner had filed this revision for striking off the plaint. The petitioner cannot ride two horses at a time, one by filing an application for rejecting the plaint and another by way of a revision before this Court to strike off the plaint, which is impermissible and hence, this Civil Revision Petition deserves dismissal.

3. In the result, this Civil Revision Petition is dismissed. The learned District Munsif, Thiruvottiyur is directed to dispose of the application for rejecting the plaint filed in O.S.No.95 of 2023, as expeditiously as possible. No costs.
