Crl.M.P.No.1245 of 2024 in Crl.A.SR.No.3469 of 2024 M. NIRMAL KUMAR , J This petition is filed to condone the delay of 60 days in filing the above appeal.

2.The petitioner as complainant filed a private complaint against the respondent under Section 138 of NI Act. The Trial Court convicted the respondent, against which, the respondent preferred an appeal.

The Sessions Court allowed the appeal and acquitted the respondent. Against which, the present appeal is filed with a delay.

3.Notice was served to the respondent/accused and though he received the notice, he has not responded. The respondent's name was also printed in the cause list.

4.In view of the above, it is seen that the respondent has got no serious objection in allowing this petition. Accordingly, the delay stands condoned and the petition is ordered.
