Company Application No.42 of 2019 in Company Petition No.255 of 2014 N.SATHISH KUMAR, J.

This Application has been filed seeking for the following reliefs: a) To direct the respondent/debtor Company to pay the debt due amount of Rs.2,11,366.92 towards entire settlement along with subsequent interest @ 18% p.a. From 01.02.2019 to till the date of final payment.

b) To direct the respondent/debtor to return the assets as per Clause 19 of the Operating Lease Agreement Nos.2 and 3 along with interest @ 18% p.a. on depreciation value of the asset from end of the tenor amounting to Rs.1,36,006.16 along with subsequent interest from 06.01.2019 to till date of returning the asset (or) c) To direct the respondent/debtor to pay Rs.3,77,610.80 being the depreciation value of the asset at the end of the tenor along with interest @ 18% p.a. on depreciation value of the asset up to 05.01.2019 along with subsequent interest from 06.01.2019 to till date of making payment.

d) To permit the Official Liquidator the cost of this application does come out of the funds of the company in Provisional Liquidation.
