JUDGMENT
Even during the earlier hearing on 27.06.2018, it is brought to the notice of this Court that both the appellants as well as the sole respondent had died. The Second Appeal was adjourned for taking appropriate steps. There after, the Second Appeal was once again listed for hearing on 31.10.2018. Opportunity was provided to the parties to take steps and to bring on record the legal representations of the parties to the lis on hand, the case was again listed for hearing on 19.11.2018. 2.When the matter is called today, the learned counsel for the respondent brought to the notice of this Court that they are unable to take steps on account of the fact that the parties have not issued any instructions to proceed with the case.
In other words, the respective learned counsels are unable to secure instructions from their respective parties to proceed with the present Second Appeal. Thus, keeping the case for an unspecified period is certainly not preferable in view of the fact that both the appellant as well as the respondents passed away and no steps are unable to taken. Thus, the Second Appeal is liable to be closed. However, it is made clear that the respective parties are at liberty to re-open the Second Appeal, if they have chosen to do so within a reasonable period of time. https://hcservices.ecourts.gov.
