... Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the 1st respondent to dispose of the representation dated 27.12.2010 submitted by the petitioner on merits and in accordance with law.

For Petitioner :

Mrs.C.Uma For Respondents :

Mr.K.Magesh, Special Government Pleader

O R D E R

The prayer sought for herein is for directing the 1st respondent to dispose of the representation dated 27.12.2010 submitted by the petitioner on merits and in accordance with law.

2. That the petitioner was working as Assistant Professor in the Department of Maths at the second respondent college. While he was working so, in the year 2010 the second respondent and three more co-employees / faculties working in the same institution seems to have given some torture to the petitioner and in this regard he had given a complaint to the first respondent and the said complaint dated 27.12.2010 since had not been considered, no enquiry was conducted and no fruitful result had come, the petitioner has filed the present writ petition with the aforesaid prayer.

3. After long years, when the case is taken up for hearing, learned counsel for the petitioner would submit that, though this writ petition was filed in the year 2011, as of https://hcservices.ecourts.gov.in/hcservices/

now she has no instructions from the petitioner despite best efforts taken by her.

4. Learned Special Government Pleader appearing for the respondents submits that, since the second respondent has already retired from the institution and the complaint was given only against him, it is not known whether anything still survives in this writ petition to adjudicate. Anyhow, if the first respondent has not considered the said representation dated 27.12.2010, the same, if the petitioner feels aggrieved, will be considered and accordingly orders would be passed within a time frame.

5. Considering the said submissions made by the learned counsel for both sides, this Court is inclined to dispose of this writ petition with the following orders.

6. That the first respondent is hereby directed to consider the representation of the petitioner dated 27.12.2010 and take action if there is any substance to that effect, in the opinion of the first respondent, and accordingly dispose of the same in the manner known to law within a period of three months from the receipt of a copy of this order.

7. With the above directions, this writ petition is disposed of. No costs.
