ORDER

This petition has been filed to call for the records in CC.No.544 of 2014 pending on the file of the learned Judicial Magistrate No.II, Tiruppur and quash the same. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the 1st respondent and perused the material placed on record.

3.On the complaint lodged by one V.T.Subramanian, the respondent police registered a case in Crime No.16 of 2008 for offences under Sections 408 and 420 IPC against S.Sivakumar, who is the petitioner herein. After completion of investigation, the respondent police filed the final report, which was taken on file in CC.No.544 of 2014 by the learned Judicial Magistrate No.II, Tiruppur.

4.It is represented by the learned counsel for the petitioner that the matter has been settled amicably.

5.Today, the petitioner/accused and the 2nd respondent/defacto complainant are present before this Court and V.T.Subramanian, the defacto complainant, was identified by Mr.Unnikrishnan, Sub Inspector of Police, Central Crime Branch, Tiruppur. have also filed a Memorandum of Understanding dated 12.06.2015, in Tamil wherein the photograph of the defacto complainant has been affixed.

6.Since both the parties have arrived at an amicable settlement and as there was no objection for quashing the prosecution against the petitioner/accused, relying upon the Judgment of the Hon'ble Supreme Court in Narindar Singh and Others v. State of Punjab and another reported in (2014) 6 SCCF 466, the proceedings in CC.No.544 of 2014 pending on the file of the learned Judicial Magistrate No.II, Tiruppur, is quashed.
