Prayer: Second Appeal is filed under Section 100 of Civil Procedure Code, praying against the Decree and Judgment passed in A.S.No.12 of 2008 dated 30.04.2010, on the file of Subordinate Judge at Vellore confirmed the decree and judgment passed in O.S.No.129 of 2001 dated 20.09.2005, on the file of District Judge (Trainee), II Additional District Munsif Court at Vellore.

J U D G M E N T

(The case has been heard through video conference) It is reported that the sole appellant died on 09.11.2010 within two months after filing the second appeal. For the past 10 years no steps have been taken to set aside the abatement and to bring the legal representatives of the appellant. This Court finds that there is no reason to keep the second appeal on Board any further.

Therefore, this Second Appeal is dismissed as abated. No costs. Consequently, connected miscellaneous petition is also closed.
