Uma Suthakar v. Nil

This Original Petition has been filed taking advantage of section 372 of the Indian Succession Act, 1925, seeking issuance of Succession Certificate with respect to the securities in the name of V.Suthakar, who died on 14.05.2021. The details of the securities had been given in the schedule to the petition.

2. The 1st petitioner is his wife and the 2nd and 3rd petitioners are his daughters. The 4th petitioner is his mother. The 2nd, 3rd and 4th petitioners are given their consent affidavits for grant of Succession Certificate in the name of the 1st petitioner. Paper publication has been effected.

3. During evidence, the 1st petitioner was examined as PW-1. The death certificate of V.Suthakar was marked as Ex.P1 and the legal heirship certificate of V.Suthakar was marked as Ex.P2. The statement relating to the securities in the name of V.Suthakar was marked as Ex.P3. The consent affidavits of 2nd, 3rd and 4th were marked as Ex.P4 to Ex.P6. Paper publication effected was marked as Ex.P7.

In view of the evidence recorded, I hold that Succession Certificate may be issued in the name of the 1st petitioner, viz., Uma Suthakar, wife of the deceased viz., V.Suthakar to collect the securities and to receive the interest and dividends there on and negotiate and transfer the securities as specified in the schedule to the petition.

5. With the above observations, this Original Petition stands allowed.
