The sole respondent in this Second Appeal died long back and the learned counsel for the appellant submits that in spite of intimating the parties, the parties are not turned up to take necessary steps to substitute
the legal heirs of the deceased sole respondent. Since the sole respondent in this Second Appeal died long back, there is no purpose in keeping this Second Appeal on pending.

In view of the above, this Second Appeal is dismissed as abated. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
