When the second appeal was listed on 08.12.2021, there was no representation on behalf of the appellants and hence, it was directed to be listed on 10.12.2021 under the caption, 'for dismissal'. On 10.12.2021 the learned counsel for the appellant is present and sought short accommodation to comply with the earlier order dated 31.01.2019 and hence, it was directed to be https://hcservices.ecourts.gov.in/hcservices/

listed on 17.12.2021. When the matter again listed on 17.12.2021, since there was no representation on behalf of the appellant, the matter was directed to be listed under the caption, 'for dismissal' today.

2. Today even though the appeal is listed under the caption 'for dismissal', the learned counsel for the appellant is not present to prosecute the appeal. The learned counsel for the respondents is present. Accordingly, this Second appeal is dismissed for non-prosecution. No costs. Consequently connected Miscellaneous Petition is closed.
