O R D E R

The petitioner is a senior citizen, aged 77 years and seeks a mandamus directing the 2nd respondent Revenue Divisional Officer to dispose her petition dated 15.02.2021 filed in terms of the provisions of the Maintenance and Welfare of Parents and Senior Citizen Act & Rules 2007. The application has been filed https://hcservices.ecourts.gov.in/hcservices/

as early as on 15.02.2021 and is unfortunately kept pending till date.

2.On instructions, the learned Special Government Pleader, who has accepted notice for respondents 1 and 2 and who is ready with the matter would state that enquiry has been initiated and is in fact listed today i.e. 16.02.2022. This is clearly contrary to her express stipulation that the petition filed under the aforesaid Act by senior citizens is to be considered and decided within a period of 90 days from date of receipt of the complaint.

3.Be that as it may, since the proceedings are stated to have been initiated now, the respondents are given a period of six weeks as an outer limit to decide application dated 15.02.2021, after hearing the petitioner and the private respondents as well as any other party, who is necessary in the matter.

4.This writ petition is disposed. No costs.
