Prayer: The Second Appeal against the Judgment and Decree made in A.S.No.9 of 2010 dated 30.04.2010 on the file of the First Additional Subordinate Judge, Salem, reversing the judgment and decree dated 08.10.2009 in O.S.No.656 of 2007 on the file of the First Additional District Munsif, Salem.

Decree: This Second Appeal coming on for hearing on 06.01.2022 and upon persuing the Ground of Appeal, the Judgments and Decrees of the Lower Appellate Court and the Court of first instance and the material papers in the suit and upon hearing the arguments of Mr.D.Shivakumaran advocate for the appellants and M.K.Janani for Mrs.M.Srividhya advocate for the respondent and having stood over for consideration till this day, while allowing this Second Appeal, this court doth order and decree as follows:

1. That the Judgement and Decree dated 30.04.2010 made in A.S.No.9 of 2010 on the file of the First Additional Subordinate Judge, Salem be and hereby are set aside;

2. That the Judgement and Decree dated 08.10.2009 made in O.S.No.656 of 2007 on the file of the First Additional District Munsif Court, Salem be and hereby are restored;

3. That there be and hereby no order as to costs in this Second Appeal.
