CMP Nos.3938, 3940 and 3942 of 2020 CMP Nos.3938, 3940 and 3942 of 2020 in A.S.No.206 of 2013 S.KANNAMMAL, J., These applications have been filed seeking to condone the delay of 40 days in seeking to set aside the abatement caused by the death of the sole respondent, to set aside abatement and to bring on record the respondents 2 to 4 as the legal representatives of the deceased sole respondent.

2. Considering the reasons stated in the affidavit filed in support of the applications and the fact that the counsel for the respondents has no objection for the delay being condoned, the delay of 40 days in seeking to set aside abatement is condoned, the abatement caused by the death of the sole respondent is set aside and the respondents 2 to 4 are brought on record as respondents in the appeal.

3. The Registry is directed to carryout necessary amendment and post the appeal for final hearing on 09.03.2022. The counsel for the appellant is directed to serve typed set of papers on the counsel appearing for the respondents.
