The petitioner, who apprehends arrest for the alleged offence under Section 406, 417, 420 of IPC in Cr.No.Not known of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant one Narmadha had invested a sum of Rs.2,60,000/- in one Mushroom Company based on the petitioner's advice. As the company failed to return any money. Hence the complaint.

3.The learned counsel appearing for the petitioner submits that this petitioner had not received a single penny from the defacto complainant and that suppressing the entire material fact, the defacto complainant had filed a bogus complaint against this petitioner. Hence, he prays for grant of anticipatory bail to the petitioner.

4.The learned Intervenor would submit that the total amount being cheated by the petitioner under the guise of investment for to return a sum of Rs.5,00,000/-. vsn complainant by sending some photographs to her husband and hence, he opposed to grant anticipatory bail to the petitioner. 5.The learned Government Advocate (Crl.Side) would submit that the petitioner is not returning any money invested by the defacto complainant in a company on his advice, the petitioner had filed the present complaint and that the investigation is still pending. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. 6.Considering the submissions made by the learned counsel on either side and taking into account of the fact that the petitioner had not been returned any money invested by the defacto complainant, this Court is not inclined to grant Anticipatory bail to the petitioner.
