J U D G M E N T
The second appeal has been filed as against the reversing judgment. When the matter was taken up for hearing on 01.12.2021, it was reported that the learned counsel for the appellant on record died and therefore notice was ordered to the appellant and it is returned stating that 'insufficient address', as there was no such person residing in that address. Notice was also affixed in the High Court notice Board. Today when the matter was taken up none appeared on behalf of the appellant as well as respondents. respondent is also not present, the second appeal is dismissed for non prosecution. No costs. Consequently connected Miscellaneous Petition is closed.
