This Application coming on this day before this court for hearing in the presence of Mr.K.Elango, Advocate for the applicant herein and the respondent herein not appearing in person or by advocate and upon reading the judges summons and the affidavit of R.Srikanth, filed herein, the court made the following order:- This Application has been filed for grant of interim custody of the minor child S.Samana, aged 9 years born on 13.01.2012 to the Applicant/Father herein.
2. The learned counsel for the applicant would submit that the minor child is in the custody of the respondent/mother and is residing at No.13/6, Maruthi Villa, Hanumantharayan Koil Street, Triplicane, Chennai - 05 which is within the jurisdiction of this court. He would submit that the applicant/father is employed as a Business Analyst in Intellect Design Arena Limited and is able to take care of the minor child. He would further submit that due to the careless conduct of the respondent/mother, the applicant/father has come up with this Application seeking interim custody of the child.
3. Despite notice being orered about half a dozen time and even after paper publication, the respondent/mother chose not to appear before this Court either in person or through counsel.
4. In view of the above said reasons and on being satisfied with the
reason stated in the affidavit filed in support of the Application, this court grants interim custody of the minor child S.Samana to the applicant/father.
5. Accordingly, this application stands ordered. WITNESS THE HON'BLE MR.JUSTICE SANJIB BANERJEE, CHIEF JUSTICE, HIGH COURT AT MADRAS AFORESAID, THIS THE 26th DAY OF JULY 2021.
