Today, when the Second Appeal is taken up for hearing, it is represented by Mr.Gowrishankar, learned counsel appearing for Mr.M.Vaidyanathan, counsel for appellant that the dispute between the appellant and the respondent has become infructuous and hence he seeks permission of this Court to withdraw the Second Appeal.

2. In view of the above, this Second appeal is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is closed.
